The FBI recently held a live chat on Twitter regarding a contract position for a linguist. The opportunity brought some interest and revealed that the FBI will prohibit users of CBD from employment.

The revelation came around the sixth question when the writer asked about the topic. Specifically, the question asked was “Marijuana and CBD are legal in Colorado but I was told I cannot apply to the FBI because I use them. Why?” You can read the response below.

A6. Although the use of marijuana & CBD may be legal at the state level, their use is an automatic disqualifier for FBI employees and contractors. You must wait for at least one year from your last use of CBD or marijuana before applying to the FBI. #FBILinguist

There’s a lot to unpack with this but, perhaps the oddest of all is the fact that they brought “state” legalization up. The use of CBD, as some have noted in the comments, is actually legal at a federal level. 

So why does the government not allow employees to use it? How does that affect them and they’re hiring process?

A Small Step Forward

Believe it or not, the FBI’s cannabis policy now is looser from what it was a year ago. That was when they reduced the waiting period requirement for applicants from three to one year since they last used cannabis. 

It was never clear before whether that included CBD but the tweet from the official FBI account seems to implicate that it does. The current guidelines for employment – as provided by the FBI – are as follows for cannabis:

Candidates cannot have used marijuana or cannabis in any form (natural or synthetic) and in any location (domestic or foreign) within the one (1) year preceding the date of their application for employment

It’s unknown why the FBI chooses to do this even though CBD is federally legal and even THC is more and more legal within the country. Completely wiping out an entire population from their pool of candidates seems like an unwise move, doesn’t it?

How Refusing Cannabis Consumers Affects Hiring

There’s no reason to assume that cannabis use would prohibit someone from being able to be a good linguist. Especially not one that’s only working part-time (the answer to another question was that the expectation for hours would be 20.)

Why would the FBI exclude the 14% of all Americans that use CBD products? There is no benefit for them in removing CBD users but allowing people who drink Alcohol. In fact, there was no guidance on alcohol usage at all.

That is in spite of the fact that alcohol is a drug that causes the user to become intoxicated and can lead to harm. It only takes around 4x the amount of alcohol it takes to be past the driving limit for alcohol to be potentially deadly.

Contrast this with CBD by taking 4x your normal dose one day (we recommend a day when you don’t have much to do.)

This isn’t the first time that the arcane cannabis rules of the FBI have hurt their chances of hiring. Recently, NY Daily News put out a story about how they were struggling to find hackers for the same reason. 

Apparently, there aren’t many hackers that don’t like cannabis.

Why This Matters

If you’re sitting there thinking “I wouldn’t want to work with the FBI anyways,” you’re likely not alone but that isn’t the point. By excluding CBD users, the FBI is continuing to push a false narrative that there is harm to the use of a federally legal substance.

While science is far behind in proving the many claims cannabis users make about the purported benefits, there are many years of anecdotal evidence. All this points to a product that (when processed and used responsibly) has little to no potential for harm or abuse.

By blocking cannabis users from partaking in even a small, part-time role within the organization, they’re ensuring to keep all contrarian voices at bay. If your opponent isn’t there to argue, you can’t lose the debate.

There is no reason to keep users of CBD – a substance that does not even lead to intoxication – from participating if they’re interested in doing so. In fact, they’d likely find themselves with a much deeper pool of candidates that are more highly qualified and happier to work.

Conclusion

This isn’t the first time that governmental ignorance has come down on cannabis and it won’t be the last. As evidence continues to come in regarding the efficacy of CBD, hopefully, government organizations will lose their bias against them.

There is no benefit to excluding such a large percentage of Americans from applying to a part-time position in your company. More broadly speaking, employers rarely care about a person’s home life except in this one instance.

Only if an employee’s alcoholism gets past the point of hurting their home and personal life to where it affects their work do employers talk to them. Yet, personal use of a non-intoxicating plant in a person’s off time without it affecting them negatively is an immediate disqualifier.

That is not equal ground.

• Genetic traits that may affect your metabolism and other bodily functions
• Weight, height, age, and other physical factors
• How frequently you use cannabis products 
• Current and typical dosage

In addition to all of this, there are many different forms of CBD. Different routes of administration (ROAs) act differently within the body and can affect the user for longer.

Oils, smokables, and vapables are typically shorter in total duration but take effect sooner. Edibles, capsules, and other oral routes typically last longer, stay in your system for more time, and result in stronger effects.

All this works together to determine how long drug screens can detect THC.

How Long Until CBD Is Out of Your System?

Depending on the factors above, there may be metabolites of THC still in your system for as long as 15 days or more. The more frequently you use CBD, the amount of THC in your CBD product, and more can make it take even longer. 

All this and more can affect the time it takes for tests to no longer be able to detect THC in your urine. 

In terms of the effect of the cannabinoids, users can expect that to be over within 5-12 hours, depending on the ROA. So, what about tinctures specifically? How long does CBD Oil stay in your system for a drug test?

How long does CBD Tincture Last In Your System?

When we narrow it down to the single ROA, the answer is still difficult. For instance, the majority of the way people take CBD is through sublingual (under the tongue) use – one which leaves the system pretty quickly.

The problem is that people also often swallow the oil after letting it sit under their tongue. While it’s not effective to only consume the oil orally, there is still some amount of the cannabinoids that will get through.

Edible cannabis options are the ones that stay in the system the longest since they undergo metabolism in the body.  The metabolites (byproducts from this) from edibles may stay in the system longer (as is evident by the fact that their effect lasts longer as well.)

Different Forms of Tinctures

CBD in North Carolina is safe once more after a recent push to criminalize it came dangerously close to succeeding. CBD laws in North Carolina had previously been dependent on a temporary law passed in 2015 which legalized the plant for a period of 7 years.

The expiration of this law would have set farmers of the plant up to be criminals in the span of 24 hours when Senate Bill 455 came through. The newly ratified law states that it is:

An Act to conform the hemp laws with federal law by permanently excluding hemp from the State Controlled Substances Act

As a result, hemp (defined as below .3% THC) has stronger legality in CBD North Carolina Law. Interestingly, the law also removes THC molecules found in hemp from the Controlled Substances list. While anything outside of that .3% limit is still illegal, this represents a large step forward for the state.

A Big Win

Farmers, producers, and retailers had no indication that any safety would be coming until the day before the law was set to expire. For many, it must have felt as though an impending doom was upon them before the government stepped up in the 11th hour. The legality of CBD in North Carolina was always temporary so all producers and retailers had their eyes on the impending deadline.

While it seems like a small victory for CBD to finally go through a legalization process like this in the year 2022, it’s still a big win for everyone in the industry. It’s this very industry that seems to be the main focus for State Governor Roy Cooper who made the following statement in a press release:

Agriculture is North Carolina’s largest industry and giving North Carolina farmers certainty that they can continue to participate in this growing market is the right thing to do for rural communities and our economy

As for CBD, North Carolina legalizing it in this way is not very usual and it offers CBD and hemp a level of protection that is not found in every state. In that sense, this is a rather large win for hemp as a whole.

North Carolina’s Hemp Industry

Cultivation of industrial hemp has been legal in North Carolina since 2017. In that time, the industry has grown to a place where there are now over 1,500 hemp producers with a license to produce hemp in the state. 

Hemp production in North Carolina is 8th in the country, representing 4% of the total production of hemp in the nation. That works out to 2,150 acres of hemp planted throughout the state, producing 3 million pounds of hemp per year.

While the tardiness of action is frustrating, it’s worth noting that it did wind up saving an industry that brought in over $10.5m last year. Hopefully, this will help other states to see the importance of protecting the plant that so many of its citizens enjoy so much. After all, aren’t representatives supposed to represent the needs of their constituents?

What Took So Long?

As a hemp retailer put it in a quote to the Avery Journal, “I don’t appreciate the drama of taking it to the last moment but the fact that hemp is now … here to stay in North Carolina … I’m a happy man.”

The Senate voted 41-2 in favor of the bill that passed (Republican Senators Steve Jarvis and Carl Ford being the only to vote “nay.”) The bill had bipartisan support with one 21 Republican “ayes” and 20 from the democrats. The legality of hemp is not a complicated issue and support for it is overwhelming.

So it’s hard to not ask the question: what took so long? 

Why did a government that is largely in support of this legislation moving forward keep its citizens on farms and in their shops dangling? All the way until the day before they’d turn into felons for their previously legal industry, citizens didn’t know their own fate.

Maybe we should just be glad that hemp is legal “now” and “to stay” in North Carolina but it’s hard to not still feel a bit of that sting from that. This doesn’t seem like the kind of issue that has nuance, it’s widely accepted and encouraged.

Conclusion

CBD is an industry that often lives in constant uncertainty. Whether it’s arbitrary laws, advertising limitations, banking regulations, or other restrictions, CBD companies often have very little certainty.

Legislation that states that hemp is permanently safe from the controlled substances act within the state is a fantastic movement forward. It would be nice to see other states take similar steps to protect the local businesses, farmers, and producers that all contribute so much to the economy of their state.

One of the main endocannabinoids we produce is Anandamine – also known as “the bliss molecule.” One of the common ways that we increase the production of anandamide naturally is through physical exercise. This is actually the same chemical that produces the “runner’s high” people talk about.

Another way to strengthen anandamide production is by inhibiting the chemical that breaks it down. FHH is the compound that naturally breaks down anandamide and research has shown CBG to inhibit it. It seems to do so while activating the creation of more anandamide as well.

What is CBN?
